SIMON'S BAKERY TERMS & CONDITIONS

Please read through my terms and conditions before making your payment. By transferring money to Simon's Bakery you confirm that you agree to my terms and conditions.

ALLERGIES & COLOURINGS

At Simon's Bakery, everything is made from scratch in small batches and while all equipment is scrupulously cleaned after use, most of it will have come in to contact with gluten, nuts, dairy, eggs and other allergens.

All products may contain some or all of the following food colourings: E102*, E104*, E110*, E122*, E124*, E129*, E133, E153, E155, E171

Please be aware of this when ordering, and let me know if you have any severe allergies.

CAKE DESIGNS

I design cakes a more contemporary style of cake with an abstract twist. I will not replicate designs of another cake maker, but will ask a client to articulate what it is they like about the cake and apply my own style.

Any sketches created as part of the design process are intended to give an approximate idea of the look of the cake and will be used to create the final cake, but invariably there will be differences when translating from paper to real life, e.g. shades of colour, position/amount of colouring and other design features.

BASIS OF SALE & ORDER  CONFIRMATION

Any initial quote is valid for the date of the event first communicated and is subject to change until the order is confirmed and the booking fee paid. If the date of the event is postponed for more than 6 months a new quote will be created. Your order and confirmation of the order with the invoice sent, and payment of booking fee if required, is considered by me to set out a contractual agreement between you and me for the sale of baked goods from Simon's Bakery. Please check that all details are correct and that you understand the full terms and conditions before placing your order.

 

Finalised orders should be placed at least 6 weeks for wedding cakes and 10 days for all other products. Where the required date is less than this, a rush fee of up to 25% may apply depending on existing orders. Once design, price and other relevant details have been agreed, you will receive an invoice detailing your cake design, and all relevant information via email. A 50% non-refundable booking fee will be payable immediately for wedding cakes and the full amount for anything else.

PRICE AND PAYMENT

If you wish to secure a date and progress with the wedding cake design process, a £100 non-refundable booking fee is required which will be taken off the final invoice. For wedding cakes, 50% of the final balance of the cost is due 6 weeks before the wedding cake is required. If the order is confirmed 6 weeks or less for wedding cakes the full 100% is payable immediately once the final price is agreed (or a negotiated plan) and the invoice issued. For any celebration cakes, honey cake, macarons or anything else, full payment is required once the invoice is sent. Payment should be made via bank transfer with details on the invoice. International orders will be subject to transaction fees.

Cake stands that are hired from me have to be returned to me by the customer undamaged and in original packaging within 7 days of the event, or unless other arrangements are agreed prior to the event, otherwise the deposit will be retained. For every day that the stand isn't returned after the agreed date, £20 will be taken off the deposit.

CHANGES TO ORDER

Changes to the design of your order can normally be made up to 5 days before the required date for celebration cakes and 14 days for wedding cakes, however, you will be liable for costs already incurred, e.g. personalised cake toppers or flowers that may have been ordered. An amended invoice will be issued if the costs change. If you wish to change to required date, every effort will be made to accommodate this, however this may be subject to additional cost depending on the number of orders I have.

CANCELLATION & POSTPONMENT 

Please inform me as soon as possible if you would like to cancel or postpone your order. Booking fees are non-refundable. Cancellations made less than 6 weeks before a wedding and 1 week for all other cakes are non-refundable. Full payments made more than 6 weeks for wedding cakes and 1 week for all other cakes, will be refunded 50%. No money will be refunded for a wedding cake cancelled or postponed less than 6 weeks before the event, and 1 week for all other cakes.

The above paragraph applies to persons cancelling of their own accord. If cancellation is a result of force majeure (for example as a result of changes in Covid-19 governmental rules) all monies will be refundable less any already incurred costs, for example buying materials, drawing up cake designs. For postponements, new dates will be subject to availability and if one cannot be found that that fits for both parties, all monies, less costs incurred, will be refunded.

If for whatever reason I have to cancel the order a full refund of any monies paid will be made (this will only be in extreme circumstances and to date has never happened), and an alternative option discussed including using a different cake designer in my network.

DELIVERY & SETUP

Cakes can be collected from Tooting, SW17, or delivered in London and the surrounding aread for an additional cost based on journey time. For locations outside of London please let me know when placing an order and we the can discuss logistics. I don't post anything I make.

I would always recommend delivering or collecting on the day that the cake is being eaten.

All products are delivered by myself - not posted. Minimum delivery cost is £15. Cost is based on duration and length of journey from Tooting (and back again) and if any set up time is required at the venue. If delivery by myself or collection is not possible, delivery by Uber taxi is preferable.

Most of my cakes are packaged in large cake boxes and are suited best to transport by car. If this is the case please ensure that it is transported on a flat and stable surface to avoid it moving around and being knocked. The air conditioning should also be kept on to keep the car cool.

If a cake is not delivered directly to the customer, I require a delivery note to be signed and kept by me as proof of safe delivery and that the cake arrived in perfect condition.

Once a cake is collected (by the customer or other transport arranged) or delivered, I am no longer liable for any interference with or damage to the cake. If there is a problem with the cake and have a complaint this must be communicated to me no more than 24 hours after delivery.

Due to the delicate nature of my cakes please ensure that the cake is placed in an environment not is not excessively warm nor in direct sunshine. The cake will arrive having been chilled and should be allowed to soften before eating, but If on the day of the event the weather is hot and the cake is not being set up in an air-conditioned environment plans may have to be amended, e.g. setting the cake up on display closer to when it is being cut or eaten, or arranging refrigeration facilities and I will not be held responsible for any damage to cake if it is placed in an adverse environment after I have made you aware of potential hazards.

CAKE CUTTING & PORTIONING

The number of portions and size will be confirmed with the customer. I provide a cutting guide for all bespoke cakes, which is given to customers and/or venue staff. I cannot be held responsible if the number of portions cut is less than first communicated if the guide is not followed.
